Debate over Dr. Besigye's case intensifies as leaders challenge evidence handling and legal processes in Uganda

The discussion about Dr. Kizza Besigye’s legal situation took another turn during the latest episode of 'The Frontline' show on NBS TV.

Hon. Ibrahim Ssemujju Nganda strongly criticized Andrew Mwenda and Gen. Muhoozi Kainerugaba, challenging them to take any evidence they have against Besigye to court rather than discussing it publicly. He emphasized, “You are not a judge. Muhoozi is not a judge. Present the evidence before the courts of law and get Dr. Besigye convicted.”


Ssemujju also questioned why the evidence, if it exists, has not yet been presented in court. He expressed concern about the motive behind discussing these allegations in public instead of following the legal process. “If they have evidence against Dr. Besigye, why are they not presenting it in the courts of law?” he asked.


Meanwhile, David Lewis Rubongoya, the Secretary General of the National Unity Platform (NUP), weighed in on the matter by referring to a key Supreme Court ruling. He highlighted that the Supreme Court had ruled that the General Court Martial (GCM) is not legally allowed to try civilians.


According to him, this ruling should have resulted in the immediate release of all civilians detained under similar conditions. “When the Supreme Court says transfer, it means that these matters should be handled by civil courts,” Rubongoya explained.


He further stressed that the legal process must begin afresh, involving a complainant, an investigation, and a review by the Director of Public Prosecutions (DPP).

On the other hand, Andrew Mwenda defended the treason charges against Besigye, arguing that he was allegedly involved in a conspiracy to overthrow the Ugandan government.


He pointed out that Besigye had not applied for bail and had not denied the authenticity of the audio recordings implicating him. “Besigye has also not denied the audio tapes; Besigye's supporters have never come out to say he was not involved,” Mwenda stated.
